By accessing or using NuanXinYu ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. Continued use constitutes acceptance of any updates to these terms.

2. Service Description

NuanXinYu provides AI-powered wellness guidance based on Traditional Eastern Medicine principles. Our AI advisors offer educational content and general wellness suggestions. They are not licensed medical professionals and do not provide medical diagnoses, treatments, or prescriptions. Always consult a qualified healthcare provider for medical concerns. In case of emergency, call your local emergency services immediately.

3. Eligibility

You must be at least 18 years old to use the Service. If you are under 18, you may only use the Service with parental or guardian supervision. By using the Service, you represent that you meet these requirements.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate, current, and complete information during registration. You may delete your account at any time by contacting us.

5. Subscriptions and Billing

Free Tier: Limited access with 10 AI chat messages per day and free articles.

Monthly Premium ($9.90/mo): Unlimited messages, all articles, personalized plans.

Yearly Premium ($99/yr): Same as Monthly, at a discounted annual rate.

Pro ($99/mo): Everything in Premium plus custom referral links, advanced analytics, and priority support.

Refund Policy: We offer a 30-day money-back guarantee. If you are not satisfied within 30 days of purchase, contact us for a full refund. After 30 days, refunds are not available but you may cancel at any time. Cancellation takes effect at the end of the current billing period.

All payments are processed securely through PayPal. We do not store payment card information on our servers.

6. Health Disclaimer

NuanXinYu provides general wellness and educational content only. Our AI advisors are not licensed medical professionals, and their responses should not be considered medical advice, diagnosis, or treatment. By using the Service, you acknowledge that you are responsible for your own health decisions. Always consult a qualified healthcare provider for medical concerns.

7. User Content and Data

You retain ownership of any content you submit through the Service. Your chat conversations, saved articles, and custom referral links are stored locally in your browser's localStorage. We do not access, store, or share your personal conversations or health information on our servers. You can delete all your data at any time by clearing your browser's site data.

8. Referral System (Pro Members)

Pro members can create custom referral links for specific countries. When you share your unique referral link (?ref=yourID), we track clicks anonymously. Referral data is stored locally on your device. You are responsible for ensuring your shared links comply with applicable laws in your jurisdiction.

9. Intellectual Property

The NuanXinYu brand, website design, content, AI response library, and source code are the intellectual property of NuanXinYu and its operators. You may not copy, modify, distribute, or reverse engineer any part of the Service without written permission. The NuanXinYu name and logo may not be used without prior consent.

10. Prohibited Uses

You agree not to: (a) Use the Service for any illegal purpose; (b) Attempt to bypass usage limits or payment requirements; (c) Submit false or misleading information; (d) Interfere with the proper functioning of the Service; (e) Use the Service to harass, abuse, or harm others; (f) Scrape, crawl, or automate access to the Service without permission.

11. Limitation of Liability

NuanXinYu and its operators are not liable for any damages arising from the use or inability to use the Service. The Service is provided "as is" without warranty of any kind, either express or implied. In no event shall our total liability exceed the amount you have paid us in the past 12 months.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new terms.

14. Community Moderator Code of Conduct

NuanXinYu allows designated community hosts (moderators) to manage specific wellness communities. Hosts must adhere to the following code of conduct:

  1. No Official Representation: Hosts may not represent themselves as official NuanXinYu spokespersons. All community management actions are performed in a voluntary capacity.
  2. Compliance with Laws: Hosts shall not post, approve, or allow content that violates applicable laws, including medical device regulations, pharmaceutical advertising laws, and consumer protection statutes.
  3. No Medical Claims: Hosts must ensure their community content does not contain diagnostic, therapeutic, or curative claims about diseases or medical conditions.
  4. Commercial Conduct: Hosts may share personal referral links in designated areas only. They may not use moderator status to pressure members into purchasing.
  5. Confidentiality: Hosts shall respect member privacy and not share non-public community information.
  6. Enforcement: Violation may result in removal of host status, content deletion, and permanent ban at NuanXinYu's sole discretion.

NuanXinYu reserves the right to modify this Code of Conduct at any time.

15. Community Moderator Agreement

By accepting a community host (moderator) role on NuanXinYu, you agree to the following terms:

  1. Role Scope: As a community host, you may moderate content, share personal referral links (if a Pro member), and share general wellness knowledge based on personal experience.
  2. No Medical Authority: You explicitly acknowledge that you are not a medical professional and must not provide medical advice, diagnoses, or treatment recommendations in any community post or interaction.
  3. No Official Representation: You agree not to represent yourself as an official NuanXinYu spokesperson, employee, or agent. Your views are your own.
  4. Commercial Restrictions: You shall not post unauthorized advertisements, promote non-partner products, or use your moderator status to pressure community members into commercial transactions.
  5. Compliance: You agree to comply with all applicable laws, including FTC endorsement guidelines, GDPR, and local health advertising regulations. Referral links must be clearly identified.
  6. Reporting: You agree to report content violating Community Guidelines to NuanXinYu administrators promptly.
  7. Revocability: This agreement may be revoked by NuanXinYu at any time without notice if you violate any terms.
  8. Liability: NuanXinYu provides the platform as a service. Hosts are independently responsible for their own content and actions.
